Terms of Service

These Terms of Service ("Terms") govern your access to and use of skycrestai.com, the FLOW Conversion Score, other Skycrest websites and tools, and related content provided by Skycrest Media LLC ("Skycrest," "we," "us," or "our"). By accessing or using them, you agree to these Terms. If you do not agree, do not use them.
1. Eligibility and Business Use
You must be able to enter a binding contract and use the sites and tools lawfully. Our offerings are designed primarily for business users. If you use them for an organization, you represent that you have authority to bind that organization to these Terms.
2. Website Analyzer and Informational Content
The FLOW Conversion Score and similar tools evaluate submitted information and publicly available website content to produce automated scores, observations, and recommendations. Results are estimates for general informational and marketing-planning purposes. They may be incomplete, outdated, or inaccurate and are not legal, financial, accounting, or other professional advice. You remain responsible for reviewing recommendations and deciding whether to act on them.
A free automated report does not include a manual audit, consultation, implementation, or continuing monitoring unless Skycrest separately agrees to provide it.
3. Services, Orders, and Offers
Paid services, deliverables, timelines, fees, recurring charges, cancellation terms, advertising spend, eligibility requirements, and any performance guarantee are governed by the applicable checkout, order form, statement of work, service agreement, or written offer terms presented at purchase. If those specific terms conflict with these general Terms, the specific terms control for that purchase.
Advertising spend and third-party platform charges are separate unless a written order expressly says otherwise. Any lead, build-time, credit, or other guarantee applies only as stated in the applicable written offer and remains subject to its eligibility conditions, customer cooperation requirements, exclusions, and remedy.
4. Payments and Recurring Billing
When you submit payment information, you authorize Skycrest and its payment provider to charge the disclosed amount, taxes, and any recurring fees according to the checkout or order terms you accept. You are responsible for accurate billing information and timely payment. Except where law or the applicable written terms require otherwise, fees already earned or services already delivered are non-refundable.
5. Appointments and Communications
You are responsible for providing accurate contact and scheduling information. Appointment availability may change, and submitting a request does not guarantee a particular time until confirmed.
By providing contact information, you agree that we may send messages needed to deliver requested reports, manage appointments, respond to you, or administer services. Marketing email or text messages will be sent based on the consent you provide and applicable law. Consent to marketing messages is not a condition of purchase. Message frequency varies, and message and data rates may apply. Reply STOP to opt out of text messages or HELP for help, and use an email unsubscribe link to stop marketing emails.
6. Acceptable Use
- Do not use the sites or tools unlawfully, fraudulently, or to harm another person.
- Do not submit a website or information you do not have the right to submit.
- Do not attempt to gain unauthorized access, bypass security, disrupt operation, or introduce malicious code.
- Do not scrape, copy, reverse engineer, or use automated means to access the services except as permitted by law or written authorization.
- Do not impersonate another person or misrepresent your affiliation.
- Do not use results to violate privacy, intellectual-property, communications, advertising, or other laws.
We may restrict or suspend access when reasonably necessary to protect the service, users, or Skycrest.
7. Ownership and Limited License
The sites, tools, designs, software, branding, reports, and content are owned by Skycrest or its licensors and are protected by applicable intellectual-property laws. Subject to these Terms, Skycrest grants you a limited, non-exclusive, non-transferable, revocable license to use the sites and tools for their intended purpose. You retain ownership of information you submit and grant Skycrest the rights reasonably needed to process it and provide the requested service.
8. Third-Party Services
Our sites and services may rely on or link to third-party platforms, including hosting, customer relationship management, scheduling, communications, payment, analytics, advertising, and artificial-intelligence services. We do not control third-party availability, policies, or actions. Your use of a third-party service may be subject to separate terms.
9. Disclaimers
To the maximum extent permitted by law, the sites, free tools, and general content are provided "as is" and "as available." Skycrest disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted or error-free operation, a particular score, ranking, lead volume, revenue level, advertising result, or business outcome. This section does not limit an express written guarantee that applies to a paid order.
10. Limitation of Liability
To the maximum extent permitted by law, Skycrest and its owners, employees, contractors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from the sites, tools, or these Terms.
To the maximum extent permitted by law, Skycrest's total aggregate liability arising from the sites, free tools, or these Terms will not exceed the greater of $100 or the amount you paid Skycrest for the service giving rise to the claim during the three months before the event that created the claim. Limits for a paid service may also be stated in its applicable written agreement. Some jurisdictions do not allow certain exclusions or limits, so portions of this section may not apply to you.
11. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Skycrest and its owners, employees, contractors, and providers from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful misuse of the sites or tools, your violation of these Terms, or information you submit without the necessary rights.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law rules. Unless applicable law requires otherwise, courts located in Idaho will have exclusive jurisdiction over disputes arising from these Terms. Before filing a claim, you and Skycrest agree to make a good-faith effort to resolve the dispute informally by written notice and 30 days for a response.
13. Changes, Suspension, and Termination
We may update the sites, tools, or these Terms. Revised Terms will be posted with a new effective date. Your continued use after revised Terms take effect constitutes acceptance where permitted by law. We may suspend or end access for violation of these Terms or when reasonably necessary for security, legal compliance, or service operation.
14. General Terms
If a provision is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; Skycrest may assign them in connection with a reorganization, financing, merger, acquisition, or sale of assets. These Terms and any applicable written order constitute the agreement for the subjects they cover.
